Terms of Service — Bagviera

1. About these Terms

These Terms of Service (Terms) apply when you access bagviera.com, create an account or purchase a product from Bagviera.

In these Terms, Bagviera, we, us and our refer to the operator of this online store, trading as Bagviera and operating from Unit A550, 8 Ruanjian Road (Zi Bian 8-501), Guangzhou, Guangdong 510640, China. The store is hosted by Shopify, but purchases are made from Bagviera, not Shopify.

By using the website or placing an order, you agree to these Terms and the policies incorporated by reference, including our Privacy Policy, Shipping Policy and Refund & Returns Policy.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law (ACL).

2. Eligibility and accounts

You must be legally capable of entering into a binding contract to place an order. If you permit a minor to use the website or your account, you are responsible for that use to the extent permitted by law.

Information supplied when creating an account or placing an order must be accurate, current and complete. You are responsible for protecting your account credentials and for notifying us promptly of suspected unauthorised use.

We may suspend or restrict an account where reasonably necessary to protect customers, investigate fraud, comply with law or respond to a material breach of these Terms. Suspension does not remove any obligation relating to an accepted order, refund or statutory consumer right.

3. Product information

We take reasonable care to describe and display products accurately. Screen settings, lighting and manufacturing variations may cause colour or appearance to differ slightly from photographs. Measurements described as approximate may also vary within the tolerance stated on the product page.

These reasonable variations do not limit any right that applies where a product is materially different from its description, unfit for a disclosed purpose, unsafe or otherwise fails to comply with a consumer guarantee.

Product descriptions, prices and availability may be updated before an order is accepted. Discontinuing or changing a product does not affect rights relating to an order already accepted.

4. Prices, taxes and payment

Prices are displayed in Australian dollars (AUD) and include all taxes that Bagviera is required to include or collect, including GST where applicable. Delivery charges and optional services are displayed before the customer completes checkout.

We do not add an undisclosed mandatory fee after an order has been submitted. Government or carrier charges that are not imposed or controlled by Bagviera may apply in limited cross-border circumstances and are addressed in our Shipping Policy.

Payments are processed securely by Shopify and authorised payment providers. You confirm that you are authorised to use the selected payment method. Promotional terms displayed with a relevant offer apply to that promotion, subject always to applicable law.

5. Orders and acceptance

Submitting an order is an offer to purchase. An automated acknowledgement does not necessarily mean that the order has been accepted. We may decline or cancel an order for a legitimate reason, including unavailable stock, an obvious pricing error, suspected fraud, an inability to deliver to the supplied address or a legal restriction.

If we decline or cancel an order after payment has been taken, we will refund the amount paid to the original payment method and use reasonable efforts to notify you.

Review product choices, colour, quantity and delivery information before submitting an order. If you need to cancel or change an order, contact us promptly. A change cannot be guaranteed after the order enters fulfilment or is dispatched. Products are sold for personal or household use unless we agree otherwise in writing.

6. Shipping and delivery

We currently deliver within Australia only. Processing times, estimated delivery times, delivery charges, tracking and address requirements are set out in our Shipping Policy.

Delivery estimates are not guarantees, but we will provide reasonable assistance where a parcel is delayed. Bagviera remains responsible for an order until it is delivered to the shipping address supplied at checkout, except to the extent otherwise permitted by applicable law.

Nothing in this section limits any right or remedy relating to delayed, failed or incorrect delivery under the ACL or another applicable law.

7. Returns, refunds and consumer guarantees

Our voluntary change-of-mind process and the procedure for requesting a return are set out in our Refund & Returns Policy.

Our products come with guarantees that cannot be excluded under the ACL. If a product has a major failure, an Australian consumer may choose a refund or replacement and may be entitled to compensation for other reasonably foreseeable loss or damage. If a failure is not major, we may provide an appropriate remedy within a reasonable time.

Conditions that apply to a voluntary change-of-mind return do not restrict rights relating to a faulty, unsafe, incorrect or materially misdescribed product.

8. Website use

You may use the website only for lawful personal or household purposes. You must not interfere with website security or normal operation; introduce malicious code; attempt unauthorised access; use the website to commit fraud or infringe rights; collect personal information without lawful authority; or commercially exploit a substantial part of the website without permission, except where permitted by law.

Reasonable access by search engines, accessibility tools, browsers and customer-authorised services is not prohibited merely because it is automated, provided that the access is lawful and does not damage, overload or circumvent the security of the website.

9. Intellectual property

The website and its original branding, text, layout, photographs, graphics and other content are owned by or licensed to Bagviera, Shopify or the relevant rights holder and are protected by applicable intellectual property laws.

You may view and use the website for personal, non-commercial shopping purposes. No ownership right is transferred to you. Nothing in these Terms prevents a use that is permitted by law.

10. Third-party services and links

The store uses Shopify and may use third-party payment, delivery, analytics, customer support and marketing services. Those providers may have separate terms and privacy notices.

Links to third-party websites are provided for convenience. We are not responsible for third-party content or services that we do not control. This does not limit any responsibility Bagviera has for providers acting on our behalf or any right that cannot lawfully be excluded.

Shopify provides the ecommerce platform but is not the seller of Bagviera products and is not responsible for fulfilling Bagviera orders.

11. Privacy

Our collection, use and disclosure of personal information is described in our Privacy Policy. Information may be processed by Shopify, payment providers, fulfilment partners and other service providers as necessary to operate the store and complete an order.

12. Reviews and feedback

If you voluntarily submit a review, photograph or other feedback, you confirm that you have the right to submit it and that it is not unlawful, misleading or infringing.

You grant Bagviera a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt that feedback for operating and promoting the store. This licence does not transfer ownership of your content and does not permit us to identify you beyond the name or identifier you agreed to display. You may contact us about removing published feedback, subject to legal record-keeping obligations.

We do not require positive reviews and any incentive for a review will be disclosed as required by law.

13. Website availability and corrections

We aim to keep the website available and accurate but do not guarantee uninterrupted or error-free access. We may maintain, update or temporarily suspend website functions where reasonably necessary.

If an obvious error affects a product description, price, promotion, delivery charge or availability, we may correct it and contact affected customers. If we cannot honour an accepted order because of the error, we will provide a refund and any other remedy required by law.

This section concerns operation of the website. It does not exclude consumer guarantees applying to products.

14. Liability

To the maximum extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable when the contract was made.

Bagviera does not exclude or limit liability for fraud, wilful misconduct, personal injury caused by negligence, breach of a non-excludable consumer guarantee, or any other liability that cannot lawfully be excluded or limited.

Where the law permits liability for a non-consumer service to be limited, our liability may be limited to supplying the service again or paying the reasonable cost of having it supplied again. This limitation does not apply where it would be unfair, unreasonable or unlawful.

15. Termination

You may stop using the website at any time. We may restrict access where reasonably necessary for security, fraud prevention, legal compliance or a material breach of these Terms.

Termination or restriction of website access does not affect an accepted order, accrued payment or refund obligation, privacy right, consumer guarantee or another right that by its nature continues after termination.

16. Changes to these Terms

We may update these Terms to reflect changes to the store, our practices or applicable law. The revised Terms and updated date will be published on the website. A material change will not retrospectively reduce rights attached to an order placed before the change.

17. Governing law and disputes

These Terms are governed by the laws of the People's Republic of China, having regard to Bagviera's principal place of business in Guangzhou, Guangdong, China.

If you are an Australian consumer, this clause does not exclude the ACL, reduce any mandatory right available under Australian law or prevent proceedings from being brought in a court or tribunal that has jurisdiction under applicable law.

If a concern arises, please contact us first so that we can attempt to resolve it promptly. Nothing in these Terms prevents either party from contacting a regulator, exercising a statutory right or commencing proceedings in a court or tribunal with jurisdiction.

18. Severability and entire agreement

If a provision of these Terms is found to be unlawful or unenforceable, it will be read down or severed to the minimum extent necessary without affecting the remaining provisions.

These Terms and the policies incorporated by reference form the agreement governing use of the website and purchases from Bagviera. They do not exclude representations or rights that cannot lawfully be excluded.
